The podcast focuses on the important decision of the Supreme Court of India in Kesavananda Bharati vs State of Kerala decided 50 years ago.  The basic structure doctrine which was there expressed became an important feature of Indian constitutional law principles.  Hon. Michael Kirby has contributed comments to the series drawing analogies to decisions made by the High Court of Australia in reasoning from the separation of powers in the Australian Constitution to the decision of that Court in The Queen v Kirby; Boilermakers’ Society of Australia; Ex parte (1956) 94 Commonwealth Law Reports254 and ibid 95 Commonwealth Law Reports 529.  Possible future applications of the basic structure doctrine of India are discussed.
